Asunto: Caso Oswaldo Payá

Tengo el honor de dirigirme ante usted, en primer término para felicitarle y desearle el mayor éxito en la defensa de los Derechos Humanos de los ciudadanos del mundo, y de igual forma le presento el caso de mi hermano Oswaldo Payá.

Mi hermano Oswaldo José Payá Sardiñas, fue uno de los mas importantes líderes políticos de Cuba en los últimos años, fundador del conocido Proyecto Varela y del Movimiento Cristiano Liberación (MCL) con el Premio Sájarov por el Parlamento Europeo y nominado al Premio Nobel de la Paz.

El activismo de mi hermano Oswaldo Payá estuvo siempre enmarcado en la Defensa de los Derechos Humanos, la Democracia y el diálogo como instrumentos para mejorar las condiciones de vida del pueblo cubano, en tales actividades en el pretendido ejercicio de sus Derechos Civiles, asumió posiciones críticas al gobierno cubano, lo cual generó persecuciones y amenazas de diversa índole, y muy lamentablemente falleció  ( al igual que Harold Cepero, joven activista del MCL)en circunstancias aún no aclaradas en fecha 22 de julio de 2012 en la provincia de Granma (Cuba) presuntamente como consecuencia de un “accidente automovilístico”, según la información pública de las autoridades del Estado de Cuba.

Ninguno de los miembros de nuestra familia ha tenido acceso al expediente realizado por autoridades policiales y judiciales relacionado con el fallecimiento de Oswaldo. Desconocemos la real causa de su muerte según el contenido del protocolo de autopsia forense, los detalles del sitio del suceso y demás evidencias recolectadas y analizadas durante el proceso penal, o si intervinieron otros automóviles durante el evento.

Durante el desarrollo del proceso, no le fue permitido a la familia asistir a las vistas del juicio, ni incorporar la evidencia de que disponemos para esclarecer los hechos, y menos aún, contar con la intervención de asesores legales y expertos forenses que representaran los derechos e intereses de la familia como víctimas indirectas. Tales restricciones generan graves dudas respecto a objetividad e imparcialidad de las autoridades involucradas en el caso. Tal opacidad ha sido el mecanismo de la injusticia.

Nuestro derecho al debido proceso ha sido conculcado y consecuentemente nuestro derecho a la verdad. El tiempo ha transcurrido y tenemos que vivir con la idea fija de las diversas hipótesis existentes de la causa de la muerte de Oswaldo y de las inconsistencias y contradicciones de la versión oficial.

Ruego a usted, honorable Alta Comisionada, que interceda con el Estado de Cuba para lograr en primer término que la familia pueda acceder a las actas procesales, evidencias del caso y, de igual forma, se realice una investigación transparente, objetiva e imparcial de los hechos y circunstancias, en donde participen expertos internacionales y expertos designados por la familia. Esta sería la única forma de llegar a la verdad por las vías jurídicas idóneas y confiables.

Subject: Oswaldo Payá case

I have the honor of addressing you, first of all to congratulate and wish you the greatest success in defending the Human Rights of the citizens of the world, and I also present the case of my brother Oswaldo Payá.

My brother Oswaldo José Payá Sardiñas, was one of the most important political leaders of Cuba in recent years, founder of the well-known Project Varela and the Christian Liberation Movement (MCL) with the Sakharov Prize by the European Parliament and nominated for the Nobel Prize of the Peace.

The activism of my brother Oswaldo Payá was always framed in the Defense of Human Rights, Democracy and dialogue as instruments to improve the living conditions of the Cuban people, in such activities in the alleged exercise of their Civil Rights, he assumed critical positions to the Cuban government, which generated persecutions and threats of various kinds, and unfortunately died (as did Harold Cepero, a young MCL activist) in circumstances not yet clarified on July 22, 2012 in the province of Granma (Cuba) allegedly as a result of a “car accident,” according to public information from the authorities of the State of Cuba. 

None of the members of our family have had access to the file made by police and judicial authorities related to the death of Oswaldo. We do not know the real cause of his death according to the content of the forensic autopsy protocol, the details of the event site and other evidence collected and analyzed during the criminal process, or if other cars intervened during the event.

During the development of the process, the family was not allowed to attend the hearings of the trial, nor to incorporate the evidence that we have to clarify the facts, and even less, to have the intervention of legal advisers and forensic experts that represent the rights and family interests as indirect victims. Such restrictions generate serious doubts regarding the objectivity and impartiality of the authorities involved in the case. Such opacity has been the mechanism of injustice.

Our right to due process has been violated and consequently our right to the truth. Time has elapsed and we have to live with the fixed idea of ​​the various existing hypotheses of the cause of Oswaldo's death and the inconsistencies and contradictions of the official version.

I beg you, honorable High Commissioner, to intercede with the State of Cuba to ensure that the family can access the procedural records, evidence of the case and, in the same way, conduct a transparent, objective and impartial investigation of the facts and circumstances, involving international experts and experts appointed by the family. This would be the only way to get to the truth through suitable and reliable legal channels.
