Rafael tiene 6 años y fue diagnosticado al poco tiempo de cumplir 2, con Hipertensión Pulmonar Arterial (HAP). Se trata de una rara enfermedad que afecta la circulación de la sangre entre el corazón y los pulmones, y tiene como consecuencia la falta de oxígeno en el cuerpo y el deterioro del corazón y otros órganos, pudiendo tener consecuencias mortales. La HAP no tiene cura y hasta hace muy poco sólo existían tratamientos poco efectivos para prolongar la vida del paciente.

En años recientes, se ha estado experimentando con una proteína llamada Sotatercept, que está dando excelentes resultados en EEUU, Argentina y otros países, confirmándose la mejora de pacientes con HAP al administrárseles la misma. Ya se estan realizando, asimismo, estudios en niños en EEUU y en Europa. El equipo médico que trata a Rafael en el Hospital Garrahan convino que, ante la escasa efectividad de los tratamientos alternativos que existen para mejorar la condición de Rafael en esta etapa de la enfermedad, era necesario intentar conseguir esta medicación. Pero el laboratorio MSD en Argentina (Merck en EEUU) se negó y por ello los padres de Rafita presentaron un amparo judicial para que, por razones humanitarias y de excepción, de carácter compasivo, se les permitiera acceder al medicamento. Un Tribunal de 2da instancia resolvió ordenar a la ANMAT y a MSD que realicen las acciones pertinentes para que Rafa pueda tener su medicación, basándose en la opinión del Garrahan que ya se han agotado todos los demás tratamientos posibles.

El plazo otorgado por la Justicia ya venció, la FDA (Food And Drugs Administration) en EEUU permitió la salida del medicamento para este caso y ANMAT autorizó su importación, pero el laboratorio, además de intentar maniobras judiciales para intentar no cumplir el fallo, las cuales fueron desestimadas inmediatamente, todavía no ha provisto el sotatercept ni ha comunicado a los padres un plazo de entrega. 

Mientras tanto, la salud de Rafael se deteriora a cada momento, ya requiere de un respirador día y noche, su vientre está abultado, indicando el exceso de agua entre sus órganos, y su corazón tiene un tamaño muy desproporcionado para su edad, por causa del esfuerzo. Su familia lucha todos los días para evitar un desenlace fatal. Hasta hace muy poco, Rafita tenía una vida casi normal de un niño de su edad, y había empezado 1er Grado, que tuvo que abandonar.

Por eso te pido que firmes esta petición, para que el laboratorio cumpla una ORDEN JUDICIAL, no estamos pidiendo algo fuera de la ley. Ayudame con TU FIRMA para que Rafa pueda prolongar su vida, con una mayor calidad, y pueda aprender a leer y escribir, a jugar como un niño de 6 años, mientras esperamos nuevos avances en el tratamiento de su enfermedad.
 

MERCK IN THE US/MSD IN ARGENTINA: COMPLY WITH THE JUDICIAL RESOLUTION AND SAVE RAFAEL'S LIFE!

Rafael is 6 years old and was diagnosed shortly after turning 2 with Pulmonary Arterial Hypertension (PAH). PAH is a rare disease that affects the blood circulation between the heart and the lungs, resulting in a lack of oxygen in the body and the deterioration of the heart and other organs, which can have life-threatening consequences. PAH has no cure, and until recently, there were only treatments of limited effectiveness available to prolong the patient's life.

In recent years, there has been experimentation with a protein called Sotatercept, which has shown excellent results in the US, Argentina, and other countries, confirming improvement in PAH patients when administered. Studies are already being conducted on children in the US and Europe. The medical team treating Rafael at Garrahan Hospital agreed that, given the limited effectiveness of alternative treatments to improve Rafael's condition at this stage of the disease, it was necessary to try to obtain this medication. However, the MSD laboratory in Argentina (Merck in the US) refused, leading Rafael's parents to file a judicial injunction so that, for humanitarian and exceptional reasons, they would be allowed access to the medication. A Second Instance Court ruled that ANMAT (Argentina's regulatory authority) and MSD should take the necessary actions for Rafael to receive his medication, based on Garrahan Hospital's opinion that all other possible treatments have been exhausted.

The deadline given by the court has already expired. The FDA (Food and Drug Administration) in the US allowed the release of the medication for this case, and ANMAT authorized its importation. However, the laboratory, in addition to attempting legal maneuvers to avoid complying with the court's decision, which were immediately dismissed, has not yet provided the Sotatercept or communicated a delivery timeframe to the parents.

Meanwhile, Rafael's health deteriorates with each passing moment. He now requires a ventilator day and night, his abdomen is swollen, indicating excess fluid between his organs, and his heart is disproportionately enlarged for his age due to the strain. His family fights every day to prevent a fatal outcome. Until recently, Rafael had a nearly normal life for a child his age and had started 1st grade, which he had to abandon.

That's why I ask you to sign this petition, so that the laboratory complies with the COURT ORDER. We are not asking for something beyond the law.
