The California Department of Corrections and Rehabilitation (herein after The Department) is considering the release of a sexually violent predator into Modoc County after serving only 25% of his 112-year sentence. 

In the early morning hours of October 1, 1993, 29-year-old Duane Keeney, a monster, kidnapped Robbie Barnes, an 18-year old resident of Cedarville, for the purpose of sexually assaulting her. 

On October 1, 1993, sometime after 1:00 a.m., Duane Keeney intercepted the victim, Robbie Barnes, as she was travelling home on the down grade portion of Cedar Pass, entering Surprise Valley. After approaching Robbie's car, Keeney jumped into the passenger portion of her car, stuck a gun into her stomach and ordered her to get out of the car. Keeney then ordered Robbie over to his vehicle, had her strip off all her clothes and get into the trunk of his car. Over the next 10 hours, Keeney drove the victim to at least four locations, each time committing oral copulation, sodomy and rape. Not only was she transported naked in the trunk of Keeney's car, she was frequently blindfolded with her hands bound tightly behind her back. While blindfolded and with her hands bound, Robbie was forced to roll under barbed wire, tied to a tree and tied to a barbed wire fence at different times during this enormously traumatizing ordeal. 

Throughout the night, Keeney not only threatened Robbie with a gun, but also threatened to kill her mother, father and little brother if she said anything to anybody about the vicious assault. Robbie spoke. Robbie told her boss, her parents, law enforcement and ultimately twelve strangers during a jury trial. 

Keeney was charged with 13 separate counts of forced sexual assault and kidnapping for the purpose of rape, with a special enhancement of personal use of a firearm. Keeney was found "Guilty" of all charges, all enhancements were found "True" and he was sentenced to 112-years in State Prison. 

The victim was told that Keeney would not be eligible for parole until 2048 and yet the Department of Corrections and Rehabilitation has scheduled Keeney's parole hearing for June 2,2022, some 30 years early. The Department has repeatedly released convicts well before their term of confinement has been met. This is not acceptable. 

As Modoc County District Attorney, I will vehemently oppose the release of Keeney, a violent sexual offender, with all my strength. I encourage all citizens of Modoc to let The Department know that we do not want convicted felons released any earlier than the law allows. Specifically, I am asking for Modoc County residents to sign a petition opposing the release of Duane Keeney until he has served at least 50% of his sentence with a potential release date of 2048.
