According to records from the Guam Department of Public Health and Social Services and research done by the Esperanza Project in 2017, one in twelve pregnancies ends in abortion here in Guam. The most common form of abortion performed in Guam was Vacuum D&C, followed by Suction Curettage, and then Dilation and Extraction. According to scientific research, these forms of abortion are violent for the life inside the mother due to the fact that they can feel pain in the womb. Abortion not only affects the life inside the womb but it also increases the risk of suicide, infertility, pregnancy loss, and damage to internal organs for mothers. 

Bill No. 291-36 (LS) seeks to ban abortions once a fetal heartbeat is detected during an ultrasound. The only exception stated in the Act in which an abortion is allowed is when a mother's health can be impaired or if her life is at risk due to the pregnancy. To ensure that abortions are banned and those who perform abortions are held accountable, the Act allows private citizens to sue any practitioner that performs or induces an abortion after the heartbeat is detected. The Act also takes away Government Action by not allowing Government Officials and employees to file lawsuits. This puts the issue in the hands of the people instead of the Government. The Guam Heartbeat Act of 2022 seeks to protect life and protect mothers by not allowing mothers to be sued for choosing to terminate the life inside the womb.
