ペットの遺棄や虐待が後をたちません。 ペットショップなどでの安易なペットの購入後、「臭い」「うるさい」「旅行に行けない」 といった理由での飼育放棄や遺棄する飼い主、また、飼い方が虐待に値する飼い主がいます。
飼い主だけに限らず、ペットを扱う業者や保護団体の中には虐待を行っているところもあります。 そうしたペットの遺棄や虐待の防止のために、飼育者の許可制を求めます。 これには行政、警察の協力も必然です。
すでに飼育者の条件などは、都道府県の動物愛護センターでは設けられており、センターから犬猫を引き取る場合は、「譲渡条件」の確認がされ、「譲渡前講習会」を受けます。それは、その殺処分をまぬがれた犬猫が幸せに生きるために必要だという認識があるからです。
この飼育者の許可制の署名は、動物愛護センターに限らず、飼い主、ペットの販売業者、ブリーダー、保護団体、といったすべての飼育者に求める、というものです。
◆一般の飼い主《自治体に申請して飼育許可証を得る。》
ペットショップなどからの購入時、保護団体などからの譲渡時で、飼い主の資格があることを示す許可証を提示することを義務づける。（飼っている間は許可証を保持する。）
・動物虐待の前科の有無。
・購入前、譲渡前に講習会受講。（講習会実施：行政、もしくは行政委託機関。行政がしっかり管理。講習内容：飼い方、動物愛護管理法などの知識を得る。）
・許可証の保持。ただし、許可証には、ペット購入、譲渡のための有効期限がある。（最新の動物虐待の前科の有無を知るため、有効期限は短め。再度、購入する時や里親になる場合は、再び許可証を申請する。有効期限の例としてベルギーは30日間。※後述）
・購入また譲渡は、その場で即引き渡しは不可。（数日間の考える時間を作る。）
・動物遺棄や虐待を行った場合は、飼育許可証はく奪。よって、所有権も喪失。
◆販売、譲渡に関わる飼育者
すべての保護施設、商業施設、ブリーダーは、動物の引き渡しの際、飼い主に対し許可証を申請することを義務づける。
・引き渡す飼育者の許可証のコピーの保管。虐待などの調査の際、資料としてこのコピーの提出を義務とする。（ベルギーの保管期間は5年間。）
・許可証の確認・登録をせずに動物を引き渡した場合は罰則あり。（ベルギーは2,000万円以上。）
◆第一種動物取扱業者（ペットショップなど）、第ニ種動物取扱業者（保護団体など） 《自治体に申請して飼育許可証を得る。》
・ペットショップ、繁殖業者、保護団体などでの虐待事件なども多く見られることから、同様の飼育許可証を義務づける。遺棄や虐待を行った場合は、許可証は、はく奪され、所有権は自動的に喪失される。
◆行政と警察
徹底した管理と虐待への意識の向上に努めることを求めます。
・飼育許可証を発行した際、デジタルでデータを永久保管。虐待、遺棄にすばやく対応できるようにする。行政と警察で連携を取れるようにする。
・虐待の認識をさらに明確化する。（動物愛護管理法を基にすることが基本であるが、ペットが家族の一員だという認識を基準にして、判断することを求めます。）
殺処分や不幸な動物を減らすためには、法律の改正が求められます。そして、それを実行するために行政、警察、国民の動物への意識と協力が必要です。 この飼育資格証明書を発行、提示を義務づけることで、動物はモノではない、という意識にも繋がり、ペットの遺棄、虐待が減ることが期待できると考えます。
《参考》 上記は、海外の法律を参考にしています。
◇ベルギーのワロン地域では、すでにこういった飼い主の許可証を義務づける法律があり、2022年７月１日から本格的に施行されています。
・購入者、里親の許可証の有効期限は30日間。（購入などを考える時はその都度、許可証を取得する必要あり。）
・許可証を登録せずに飼い主に動物を引き渡したペット業者や保護団体は15～20万ユーロ（約2,000万円～約2,700万円）の罰金。
・ペットとは、犬、猫、馬、鳥、ハムスター、ネズミ、魚、鶏、亀、爬虫類、ウサギ、フェレット、ヤギの全種類。
・初回訪問後、正式に売買または養子縁組の締結をする前に、最低5日間の反省期間が課される。
・未成年者は基本的に動物を飼育、購入できない。
・動物を引き渡す際、飼育許可証のコピーをし、5年間保存する。この記録はあらゆる検査に使用される。
◇フランスでは2024年以降、ペットショップでの犬と猫の販売が禁止されます。その法律改正に伴って、飼い主に対しても規制が強まりました。
・18歳未満の未成年者には、購入に親の同意を義務づける
・購入や引き取り希望者には動物の飼育に関する知識などを証明する書類への署名が義務付けられる
・引き渡しまでに７日間の解約可能な期間が設けられる。

◇In the Walloon region of Belgium, there is already a law requiring this type of owner's permit, and it has been in full effect since July 1, 2022.
