Why this petition matters

We, the undersigned, representing diverse all free and honorable Kenyans in defense of Palestinian liberation along with organizations and civil society actors, express our deep concern over the decades-long occupation of Palestine and the recent unfolding genocide and ethnic-cleansing in Gaza. Our collective plea stems from the need to address severe human rights violations and the role played by Israel and her allies in perpetuating this injustice and we build our plea from our similar anti-colonial struggles that bind Palestine and Kenya. 

We are dismayed by the initial stance of the Kenyan Government, which contradicts the values and aspirations of Kenyans who have experienced the effects of colonialism. The government's response fails to reflect our collective will and places undue support behind an oppressive regime.

The situation in Gaza demands immediate attention. Israel's actions, including the "complete siege" of Gaza, indiscriminate carpet bombings, and displacement of civilians, amount to a form of collective punishment in violation of international law. The civilian population, including children, is facing unimaginable violence and displacement. 

At the time of writing this Petition, Israel had gone beyond the prescribed limit of proportionality and engaged in ethnic cleansing, displacement for purposes of illegal expropriation of Palestinian lands and resources, genocide, war crimes and crimes against humanity targeting unarmed noncombatant Palestinian civilians, including women, children, 
the elderly and Persons with Disabilities. The State of Israel has perpetrated this through sustained bombardment of refugee camps, schools, places of worship and hospitals. In addition to the bombardment, Israel has used and continues to use WHITE PHOSPHOROUS BOMBS on civilian populations in Gaza. White phosphorous is prohibited under international rules of war. As at the writing of this petition, Gaza Health authorities have established 11,500 Palestinians have been killed in the Israeli bombardment and ground invasions. More than 4,700 are children and 2.3 million Gazans have been made homeless as a result. 

In light of this, we urgently call on the Kenyan Government led by President William Ruto to:

1. Issue an unequivocal condemnation of Israel's colonial and genocidal occupation of Palestine, calling and advocating for an immediate ceasefire.

2. Indefinitely suspend all diplomatic relations with Israel.

3. Order the closure of the Israeli Embassy in Kenya and an immediate expulsion of the Isreali ambassador Michael Lotem.

4. Order the closure of Kenya's Embassy in Israel and recall the Kenyan ambassador to Israel, Samuel Thuita

5. Present a parliamentary motion condemning the Israeli occupation of Palestine.

6. Advocate at the African Union and United Nations for:
   - Immediate and unrestricted access to Gaza for humanitarian aid.
   - UN protection for the 2.3 million Palestinian civilians in Gaza.
   - An end to the siege on Gaza and a rejection of ethnic cleansing.
   - A swift investigation by the International Criminal Court into war crimes and crimes against humanity, as per the relevant UN and international laws.
   - Activation of UN mechanisms to end and punish crimes against humanity, holding perpetrators and enablers accountable.
   - A comprehensive military embargo on Israel.

We urge the Kenyan Government to align its response with the principles outlined in the Constitution of Kenya, 2010, respecting sovereignty and upholding values of participation, rule of law, transparency, and accountability.

Furthermore, we invoke the principles of the United Nations that grant the right to occupied people to resist occupation by any means necessary. We highlight the ongoing carpet bombing of Gaza as a violation of these principles and call for immediate action.

We also draw attention to the Nuremberg Principles on war crimes and the Mandela Principles on the right of Palestinian political prisoners being illegally held in Israeli prisons. The Kenyan Government is urged to address these violations in alignment with international law.

Our tied history of oppression and struggle under colonialism, forms an imperative bind and connection to the Palestinian struggle. In the spirit of the MauMau freedom fighters, we ask the government of Kenya to align and affirm it's solidarity with the Palestinian people. The people have spoken, and it is now time for President William Ruto and his government to listen.
