During the pandemic, the government of Canada discriminated against those who chose to exercise their Charter right to bodily autonomy by denying them the right to board an airplane, train or ship and restricting their right to cross our national border.

The Honorable Brian Peckford, the sole surviving author of the Canadian Charter of Rights and Freedoms, along with others including PPC leader Maxime Bernier, filed suit against the government for this violation of our rights.

Lawyers from the Justice Center for Constitutional Freedoms were making headway when the government played dirty. Their lawyers asked that the case be declared moot, and dropped, as the travel restrictions were no longer in place. Justice Jocelyne Gagné agreed and the case was dropped in late September.

Declaring this violation of our Charter rights moot because the travel restrictions are no longer in place is like declaring an assault case moot because the assault is no longer happening. A crime has been committed and the Canadian people deserve justice.
