We, the undersigned are writing to you in your capacity as the Attorney General of New Zealand whose position symbolises both the political and legal sectors of our society.

We are writing to you because we believe that the “Stop Co-Governance Tour” lead by Julian Batchelor is (allegedly) inciting racial disharmony.

It is extremely disappointing to see that he is using the Police as his personal security guards at his events as Police presence is required to quell the emotions and reaction of the Māori community members he is attacking.  

We enclose multiple examples below of the (alleged) racial disharmony Julian Batchelor is inciting with his mis-information, lies and insults towards Māori. This includes video footage of the events, news and his daily blogs on his website. This tour has only just started and has the potential to cause further racial division overtime as more Māori find out what this tour is all about. The picture becomes clear when reading the inflammatory content he posts each day on his website blog.

We respectfully request, that you act with urgency to invoke your powers pursuant to section 132 of the Human Rights Act 1993 and to seek to hold Julian Batchelor accountable pursuant to Section 131 to avoid any further harm to our communities, society and country.

The Human Rights Act 1993 prohibits discrimination on unlawful grounds and similarly section 19 of the Bill of Rights Act 1990 affirms the right to freedom from discrimination, it states,  

“Everyone has the right to freedom from discrimination on the grounds of discrimination in the Human Rights Act 1993”.

The Human Rights Act 1993, states:

Section 61 Racial Disharmony

(1)    It shall be unlawful for any person –

(b)    To use any public place…..or at any meeting to which the public are invited or have access, words which are threatening, abusive or insulting;

Being matter or words likely to excite hostility against or bring into contempt any group of persons in or who may be coming to New Zealand on the grounds of colour, race or ethnic or national origins of that group of persons. 

Section 131 Inciting Racial Disharmony

(1)    Every person commits an offence and is liable on conviction to imprisonment for a term not exceeding 3 months or to a fine not exceeding $7,000 who, with intent to excite hostility or ill-will against, or bring into contempt or ridicule, any group of persons in New Zealand on the ground of the colour, race, or ethnic or national origins of that group of persons, -

(a)    publishes or distributes written matter which is threatening, abusive or insulting….

(b)    Uses in any public place…., or at any meeting to which the public are invited or have access, words which are threatening, abusive or insulting, - 

being matter or words likely to excite hostility or ill-will, or bring into contempt or ridicule, any such group of persons in New Zealand on the ground of colour, race, or ethnic or national origins of that group of persons.
